Permit area includes mining and support areas, facilities and roads. Permits are also required for exploration activities and processing plants.

(c) Subsection (a)(5) does not apply to a surface coal mining operation that in the year preceding May 9, 1979: (1) produced coal in commercial quantities and was located in or adjacent to alluvial valley floors; or (2) had obtained specific permit approval by the commission to conduct surface coal mining operations in the alluvial valley floors.

The law assumes mine operators are responsible for any impacts to water supplies within 1,000 feet of a surface coal mining operation, unless the operator can prove otherwise. Beyond 1,000 feet, it is the responsibility of DEP to prove mining caused any water supply problems.
